There is a little gear like object that most likely needs to be replaced. I forget what the part is called, but IIRC it's somewhat pricey (40-50?). Do a search on the forums, its floating around somewhere..

Seat recliner gear, $40 and 2 hours of your time...common problem with the E36 (not sure why more so on the passenger than the driver side)

    Linky linky to the fix

It's not hard, it just take some time. It's also a good excuse to take out a seat and clean underneath.

No problem, I did mine in about 2 hours with basic hand tools...

The site for the gear is http://www.odometergears.com/subpages/E36FAQ.html and its not hard at all. I had mine apart and i looked at the gear but didnt want to pay 40 dollars so i just put hte gear back in in a position i am fine with and left it. my passengers gotta deal with it so whatever lol.

when this normally happens can you move the seat around? it would seem if the gear stripped you would be able to lift it up.

in my case i cant lift it, thats why i ask.

Mine i usually couldnt lift up but sometimes if i push forward hard enough and keep going back and forth with the controll itll catch and go up but once it goes over a revolution it just stops again.

all I did on my moms 535 was removed the seat, and I took out the worm line and just put it back into the motor while moving the seat control until the seat went back to normal. Through research on the internet, it seemed like I might have had to replace the motor or customize the line, but I didn't do either and I fixed the seat.
