I figured an issue like this would have been noticed by many members, especially those that do work on their own vehicles. Is this claim just complete BS?
This is an legendary design flaw of the e36. I didn't know the e46 was as susceptible.
This issue's been getting reported for years. What exactly do they hope to gain from a lawsuit? It's not something that can be fixed, I don't think. At least not without basically rebuilding the entire rear unibody, which would be more expensive than just building a new E36.
I wonder if the VANOS problem is also heading towards something like this.

E46 models do suffer from this failure...but the failure rate is less than 2%...so you don't really need to stress about it. The reinforcement kit is less than $500 and can be done by anyone who can pull off a good rosette weld.
*It is absolutely fixable...turner motorsports does it all the time.
