One more piece of anecdotal info...this from the ETK. I know that the parts referenced there are sometimes used for "how they're repaired" instead of "how they were built" but I couldn't help myself in posting this:
EDIT - since no one jumped on this I'll explain what this pic from the ETK indicates....that for the 1998 model year, the ZF transmission changed from S5D 310Z (95-97) to S5D 320Z. Interesting given the clustering of "fails" on 1998 models.

just dropped mine off tonight at the dealer. was going in anyway and i wrote it down to be looked at. i also printed out the list of all the cars for them as proof. its about 45 degrees out here so it will be nice and cold. the battle with them starts bright and ealry tomarrow, wish me luck, this must be the worst dealer to do buisness with!
my car sits in my garage every single night and it still does this, hot or cold. i dont think temp is as much of a factor. i drove home tonight at it was about 15-20 minutes then went bakc out shortly after for another 10 minute drive and it still did it. i went to a shop nearby with a freind who was looking at m3's and we took one out for a ride and i got in after and this problem was not there. this was a '95 m3 with 75k. its a shop that buys flood and stolen cars in ct, the damn clutch wouldnt catch on it, and it was falling apart. the gas line fell off!!!! they said no big deal and still wants $18000 for this piece of shit.
i'll report back tomarrow on how i back out with my car, hopefully i can get a new tranny. good luck everyone

Mike, good idea, I'll also PM you my build info. I left my car out last night, 48 degrees this morning, still does NOT show the symptom, 98 M3C, build date 02/98, assuming ZF S5D 320Z transmission. It's cool that we have a list and all, but what happens now? I'd love to get my trany fixed, but I just don't have the cash. Is there a way to file an official complaint or something of that matter?
This will probably go the way of the plastic water pump impeller.....unless you're still in factory warranty (some 99's) or extended/CPO you'll be on your own. That's why it's important to keep poking this to determine what to fix and how. Hopefully someone will find out how to remedy this without replacing the transmission.Originally posted by vjlax18

I like the BMW too much though. I hope this is an easy fix. E-mailed the shop I bouight the car from. Not thrilled with them as they didn't take care of some things like I asked. Still I'll have to see what they say.
waiting to here what they say about tranny. its at the dealer and im going to stop by after class today so ill report back around 12. wrote out the problem completely fr them. i also noticed in a '95 m3 i was in yesterday it shifted much much smoother then mine does. did not stick at all in 5th gear. my belief is that it is the spring. if you push the lever towards reverse it shoots back to neutral when let go, but doesnt have enough pressure on it to go back from reverse. i don't feel its getting binded. seems like the spring has weekend to the point that it is borderline doing its job, or possibly bent slightly. hopefully ill be the first to report back with some type of results, good or bad.

You bring up a good point, 98///M-DROPTOP... having production dates of affected AND non-affected cars would be beneficial in narrowing down the problem.
It was only 35 degrees out this morning, when i got in my car to drive to work (garaged), but still no signs of the problem (Thank God!). Hell, i'm still worried about the possibility of my oil pump nut being loose!

Hey Jim, excellent! With your transmission apart and an expert looking at it, maybe we'll get some good indication of whats wearing down, ie, the spring, the pin, or something else, leading to this strange phenomena. BTW, Im in a garage, but its a communal type garage with many openings to the outside and many levels. BTW, best thing if you want to establish data points is just read the car's temp from its ambient temp sensor. Mines been pretty much near 60 when Ive been noticing it.

I forget whether it was here or on another digest, but Im pretty sure that I saw both at least 1 or 2 '95s, and there even was one Getrag effected customer! Lets be careful about jumping to conclusions too quickly. Im all in favor of trying to find patterns in our explorations, but the danger is once we accept a piece of evidence as fact before we really should, all investigation down those lines ceases, and if its done prematurely, we might wind up overlooking an important piece of evidence.
As for next steps, IF the only remedy really is to replace the tranny, first, do we know whether brand new or remanned units are what would be used, and, second, do we have any idea of cost? My ETK disk has no prices in the database unfortunately.

Add one more to the list. After reading this thread, I got in my car this morning (about 40 degrees outside) and throught, hmm, i wonder...
It stuck under fifth alright, but it must've been doing it for a long time, I just never noticed. Anyway, it's a 98 model, probably around January production, but not absolutely sure. And no tranny mods on my car.

just got my car back form dealer. tranny will be fixed under bmw cpo warrantee. they did recognize that i was losing the 5th gear detent. i dont know why it was so easy to pull this off but it might have something to do with them having to kiss my ass for all of their mistakes, which is why my car was there in the first place. They are now aware of this problem and are actually going to fix it. i will make an appointment later for the work to be done, thye said 3-4 days.
i asked what they would do and they said pull tranny, see whats wrong with it and fix that. i really hope they aren't planing on just replacing that spring. i hope i get a whole new or rebuilt tranny, mines not the smoothest!
so yes, this can be fixed under warrantee, i can't wait to see how others have made out.

That's great news Matt, wish this had happened about a year or 8,000 miles ago, or that I had purchased the extended warranty.

Matt, much congratulations. What dealer do you use? I see youre in connecticut. I wonder, if my connecticut dealer should not be so cooperative, how do you think your dealer would react to a customer who theyve never seen, but is under warranty, show up with the same problem? Strictly conjecture, I realize. BTW, do you have a short shift kit, or any other mods?

i had a uuc kit on my car for about 3 days and took it off. this was back in july. just didnt like it. the dealer i used was bmw of north haven. in my opinion they are assholes and i wouldn't go there except they are 2 minutes away. i would think if you came and had the same problem they would be forced to fix it. i mean if they are doing mine and you have the same problem, then they can't deny you the same service they gave me. i'm alittle worried about how they plan to fix it. i dont like the idea of them taking the tranny apart, since they have no clue how to do much and they do treat customers like shit. i've never seen anyone happy with their service. if you want i can give you directions and a number to call.

Hrm ... I installed the UUC SSK and swapped tranny fluid after my main warranty expired. (Still have CPO though.) Took it in for this (couldn't repro) before all of that. Think I have to take it in for cat replacement & an Inspection I soon anyway ... everyone, wish me luck.
Well, guys, Im bringing this thread back, because I just dropped it off at the dealer, and will hopefully have some kind of response for you all tomorrow as to what is going to be done about my transmission issue. I was amazed to see that this thread has over 100 responses! Clearly, its hit a thread with alot of people. BTW, its been so long since Ive felt a proper BMW 5 speed, that I took the chance to sit in a brand new Z4 sitting in the showroom. Boy, that felt nice! With this car, you sure dont need any short shift kit either. Throws felt exactly like mine do, minus the fifth gear issue. Theres no hint of any friction or stickiness there!i asked what they would do and they said pull tranny, see whats wrong with it and fix that. i really hope they aren't planing on just replacing that spring. i hope i get a whole new or rebuilt tranny, mines not the smoothest
I didnt discuss whatifs or anything like that with the srvc writer. I think he knows I'll go balistic if they dont fix this covered. So, wish me luck, and lets hope for the best. Do any of you have any updates since your initial posts? Slvrm3, did you find out how your dealer was going to deal with the problem? Did they go in and replace anything, or did they just do the whole tranny like you wanted?
