My 99M3 has around 67k miles. I received this warning on the OBC a few days ago but it went away before I had a chance to check the tail-lights.. It came on again today, I checked the lights immediately and they were fine. My clears are not OEM but have never caused me troubles in the past.. Should I be looking at the trunk wiring harness?

probably a brake light circuit anyways.
Does it happen only on start-up while your foot is on the brake? If so there is a connector or something of that nature, not exactly sure what the part is, that is above the brake pedal and under the dash that goes bad and leads to the brake light fail signal. Search for brake light fix and it should come up. It is only supposed to be around $10 for the part at the dealer.
Mine does the same thing with cheapy clears, i have a bulb that always comes loose and it says 1 brake light fail. Check all your bulbs and make sure they have a secure connection and/or are not blown out
hmm.. it says Brake Light Failure and I had the Circuit fixed around 10k miles ago.. It does it mid driving and no, I didn't have anyone press on the pedal while I watched.. I backed into a parking space next to the bank and looked in the reflection of the glass and saw that all the brake lights were coming on normally..

The problem is with the design of the brake lights. I have this same problem occassionally when i leave the car outside overnight or if i leave it in the rain. Moisture gets built up in the lights and trips the brake light failure error.
i have the same problem with my 98 m3 and i have replaced the bulbs and it still seems to do it so it must be the wiring on the taillights, its mostly just a pain in my ass and i really dont want to pay to get it fixed!
well I know up until a little while ago my driver side tail light was giving me a problem. It would say brake light failure, and I'd put my cd case on the brakes and walk aroudn back. Sure enough it was out, but if I tapped the outside of hte lights, it would come back on. It was like it was shaking it's conneciton loose. Finally one time, I left the car on, and the case on the brake, and started messing with them, I found if I turned the bulb holder in as far as I could turn it, it actually wasn't as bright as a cm back or so. Liek it would be real bright, then when I turned it that extra bit, it would dim, so i tried stopping when it was brightest, and it hasn't giving me the code since.
