I posted this in the software forum too. Just picked up a 2010 35d. Tried connecting with ISTA and I get an error. Car can't be identified check PAD Active. ISTA works just fine with my e53. I tried using INPA and that failed too. Just for the heck of it I downloaded eaten files from bimmergeeks and ran bmw coding tool.
Any help would be great.

Yes it's a DCAN cable with the 2 pins soldered together. It works just fine with my e53 in ISTA.

You need a new cable without the 2 pins soldered. Get a switchable cable that will work with the e53 and the e70...

That's exactly what I just discovered. I pulled out an old scan cable that wasn't modified and it worked like a charm. Still can't get INPA to work with the car but ISTA works fine
