Sport Button Not Turning On -2008 535i M Package

Hey guys,
I am looking to purchase a used 2008 535i M Package with 150,000 km on the car. Everything drives good and my mechanic checked out the car as well, the only issue I'm having is that the sport button doesn't turn on (green led) when I press it. It has the new electronic shifter, so it does go into S when I shift the gear to the left into M/S mode, but there is also a specific SPORT button right under the gear stick with an led, but it doesn't turn on when i press it. I have attached an image below. I was wondering of any one has had or knows if this issue, and what may be causing it?
