I just bought a 2014 435i. 51k miles, not that is matters but m sport/brakes/and m suspension
8 speed automatic
I really want to like this car.... BUT
When the car is cold (has sat overnight), when I go to the end of the street (maybe 200 yards) in normal Drive, and in comfort....as I approach the stop sigh at the end of my street when it downshifts to from 3rd to 2nd and then from 2nd to a complete stop...it downshifts hard - it is very annoying but not a deal breaker. I had a indy shop flash it but it almost feels worse - I am going to have the flash removed and then take it to my dealer.
Also, at times, when I am turning (I know that probably has nothing to do with anything) and getting on the gas it hesitates....
My question is this:
Has anyone has anything similar to this happen and did software help or fix it?
I am sure I can get it to do it for the shop, are they going to tell me this is normal?

You need to make sure they pull the codes to see if the car knows about something that is not working correctly.

I have a fairly good scanner. It does not have any codes in any modules
That isn't normal, I would scan it with a scanner that reads BMW manufacturer codes, and/or take it to a dealer or experienced BMW independent. A scanner that reads P codes is not appropriate for this. There are around 20 modules in your car and you will have codes for something. The car stores everything, every little fault from the past. Also, a BMW oriented scanner can view a lot of extra live data needed to be able to diagnose.
A fluid change doesn't fix broken things, but it may be worth doing.

What he's telling you is that an OBD scanner has only the functions mandated by law. A scanner at a dealer or good indy shop WILL find faults stored, and they may point to something going on. Or not. Depending on the severity, it may just be something that happens in cold weather. Or the PO may have put new (and possibly incorrect) trans fluid in it, or flashed the trans for firmer shifts. And no, you *shouldn't* need new trans fluid at 50k, but ya never know.
