Need help understanding window problem E46

I recently purchased a beautiful 2006 330ci convertible. There is one thing I don’t understand and it makes me crazy.
The drivers side window operates normally I think,,. When the window is raised it closes then “bumps” the last 1/4” or so and seats into the seat on the convertible top. There is an audible “bump” heard when the window seats closed. However when driving and I put the window up is does not seat. Rather it stays about 3/16” away from the normal position creating a gap between the back edge of the drivers window and the gasket on the front edge of the rear window. If I stop the car and operate the window it closes normally and seats properly. Get the car moving and it closes with the gap.
The window appears to raise fully but the rear edge of the window seems to point away from the car body resulting in the gap.

    any suggestions?
