Was doing a u-turn and think the lady blew a red light. Anyways haven't got the car out of impound yet, How hard is it to change the axle compared to lets say a civic. Any special tools needed? Any recommendations to change both or anything else. Thanks newbie e38 owner, Has +400,000km all original.

These cars don't have solid rear axles, so they are a snap to replace. Basically just remove the CV joints at both ends.
Doesn't look like your problem, though. It might be as simple as a bent suspension arm, or the problem could be as bad as the attaching points for various suspension components have been knocked out of place - think bent frame. Looks to me, though, like she contacted the tire/wheel and that applied force that likely bent the rear control arm - which is a simple fix.
You will have to wait to get it back to see what the problem actually is.
Are you sure the half shaft is bent? There are control arms back there that help align the wheel. If the arm broke or bent or if the mounting broke or bent, you are looking at different work than replacing the half shaft.

What racer said. You have a sub frame that is bent or control arms or the mounts on the sub frame for the control arms. The cv joint would have handled the bending on the prop shaft.
