Body Damage-Totaled? 2002 330CI M Sport

Hello everyone,

I am working hard to try and save my car from an accident a few weeks ago.

I have a 2002 BMW 330CI M Sport. The vehicle was in great condition with only 31,000 miles and treated well

A few weeks ago I was hit by a dump truck and had to have my insurance company involved. Needless to say the insurance company saw the car as an immediate write off once they saw the "2002" and deemed it to be a total loss. (cost to fix and not that the car was irreparable)

I have asked the insurance company to slow down after the valuation of the car was low balled. As an example, the value of the hardtop was listed as $250.00 and the low mileage was not being considered

So what am I here? If the car is deemed to be labelled as a total loss, I will have to look into repairs myself. The bumper and quarter panel will need to be replaced and I understand the quarter panel is no easy fix. I am looking for help to find parts to fix and any help that anyone can offer. I am considering the idea of just focusing on the quarter panel repair and finding a bumper from a coup to get me through until I can find the right one.

Here’s what will likely happen. The insurance company will write off the car. Replacing that quarter panel may actually require the use of a frame alignment system. Why? The sheet metal is part of the car’s structure.

You can take the “write off check” from the insurance company and fix the car yourself. It won’t be cheap to fix it properly, though.

That's what I was expecting to happen as well. The insurance company has stated that the car cannot be returned to me if I choose to take the payout. The plan was to take the value minus the salvage cost and minus the deductible. According to my insurance company, that was an "old way" of doing things (I live in Ontario Canada for context) and I actually suspect that they have no intention of turning the car over but for now I should stick to facts that I know.

Worst case scenario is that I drop the claim and take the car back and look for parts myself..

Other driver at fault, right?
Get a lawyer to demand repair if that's what you want. They are obliged to make you whole.
While ugly, that's not a big hit.

If somebody Caused the damage there insurance should repair it but that is a heavy repair
