P2440 stuck valve bank 1

Alright so I have a 325i 2003 m56 sulev here in California. And in cold weather I get a cel for a generic error p2440. I have pa soft 1.4 and can read the codes on my laptop as well, it confirms that the valve is stuck. Since I live in California I cannot code this piece of my car out if im correct. Has anyone attempted to clean the valve? Ways to test it? Is my only option seafoam cleaner? I’ve replaced the manifold gasket and some of the vacuum lines while doing the cooling over haul. Just kinda stuck with a cel in the cold.
