a 2004 325xi with 135k that has been meticulously serviced by one of the best BMW mechanics in the area for $5500?

Go with the latter car. BUT, have the car undergo a Pre-Purchase Inspection (PPI) performed by a reputable shop that specializes in bimmers. Try www.bimrs.org to find a good shop.
I’d rather have the E39 530i, but if you can’t do your own work, you are probably better off with the E46 325xi and using the same mechanic that had been servicing it. Both are old cars with high mileage that will be needing work. And the cost of the work is it based on the $5k you paid but the $40k the car cost new.
For most people who want a cheap car that is cheap to maintain, I recommenda Honda or Toyota.
Both are good daily drivers but what exactly are you looking for? The 325 with awd will be better in the snow/rain. It's also smaller. I'd probably lean towards the 530i just because you can use the extra money you would have used to purchase the 325 on preventative maintenance(tune-up, oil change, coolant system overhaul, brakes, etc). As stated, both cars aren't super expensive to maintain but with their age and mileage, they will have problems, sooner or later.
