Ok guys I purchased another E31 850 this time and when I replaced the batteries about 30 mins later I looked outside and My FTP was on. I checked tp make sure that the switch was off and everything was in the correct spot. Have anyone one seen this before. Was do I need to get refurbished?

Unless there has been some 'additional wiring' added - then the two possibilities are the Crash Control Module (N17) or the FTP relay (K52z):

Pop N17 out and see if they go off....

Also check your wiring harness from the engine bay to the FTPs to see that the insulation hasn't frayed and it's causing a short, or bridging the circuit on.
The wiring on my car was completely frayed and I had several wires completely un-insulated.
