Do these lights normally work when unlocked. My key fob broke and I was given a unlocked key fob from newer bimmers so would I have to get it programmed to see these lights work?

Humm, I am not sure what lights you are talking about besides the running lights. Second, a keyfob has to be one of the keys in order to work properly that I know of.
This is an E-46 we are talking about correct?

There are companies out there that can program the key to the car, try calling a local locksmith to see if they can also cut the key. What it will do is take a place in the EWS that is either an used/lost key or an unused slot. You have up to 10 keys for that EWS at 1 time.
Now if you have a old key that doesn't work, send it to this guy: www.bmwgm5.com
