That price is crazy for a non-sport 540i touring, regardless of the mileage. I really hope nobody pays that asking price, it's completely absurd. If you insist on paying over $10k for a 540i then just go and find an M-Sport touring.

That seller always has some different stuff on eBay. Has a 17k E38 on their right now. Gets excellent reviews from people all the time.

A user from the M5board purchased an 2000 M5 from that seller and discovered a can of worms.
Seller may or may not have known and i guess its a risk a buyer takes... but thought i'd share.
