My mechanic had a look in there with a torch and said there is nothing in there, he said it looks like the previous owner deliberately hacked off the flap with a saw or something. The pin was also missing but we both looked in there couldn't find any parts..
Here's something I have noticed additionally. I have not yet replaced the DISA unit and I will I am just worried that this wouldn't solve my problem. So I want to give additional information. I have noticed that upon starting the car up and driving as long as I'm on D there is almost no misfires or vibrations or any sort of problems even if I'm stopped on D and holding down the brakes. For some reason if I put it in P after a short amount of time the rpm will start to fluctuate and the cylinders would begin to misfire. Could this still be DISA valve related? Thank you
Alright here's an update after the disa was replaced the misfire seems to completely has stopped been two days with no shaking coming back I guess it's fixed.
Alright, I checked the fault codes once more and this is roughly over a week after repair. I noticed three fault codes this time so the issue is really narrowed down at this point and it says that there is a voltage problem with the O2 sensor in bank 1, a cylinder misfire in bank 1 and a system too lean in bank 1. Then I decided I would monitor the O2 sensors on Torque. The voltage seems to be spiking constantly up and down for the O2 sensor in Bank 1 from between 0.2-0.9 but, for the other banks it seems quite stable. Please check the screenshot for O2 1x1. Could that sensor be busted?

If you have a Bentley manual use the electrical diagrams and a digital multi-meter to trace the O2 sensor. Only reason I would say this is the PO did some questionable things what's to say that part of the O2 harness isn't grounding out or temporarily shorting? I seriously doubt this would happen but it could either be that, a bad sensor, or engine management.
