Thanks blakamin, its been a loooooong time coming. I've learned alot about so called bmw experts who know NOTHING and will 'f' your over and lie about everything and actual bmw experts that dont really have the time to do there expert work!

Will be hoping to find a good local bmw garage; but like most in here, im going to be doing much of the work myself.
Should've taken it to Motor Works West in NJ. I doubt it would have taken 1+ year to do the swap then. Though finding an honest/reliable indy is impossible. My mom just took her Acura to an indy here and they disconnected her power seating cable and tried to tell her she needed to pay $100 to fix the gears.

Suffice to say im just trying to stay cool. Have to work out a time thats works for him so I can get there and safely remove my cars unmolested.
He is an awesome mechanic... but bad things happen to good people which really f's them up. I dont need either of my cars there... kinda wrote them off over a year ago. Now that I have another kid, got another car, have moved and changed jobs... I mean life goes on!!
Really is just vanity at the moment wanting my project cars back.
I can walk away if I have to. Life is to short and precious to get too involved in the cavernous vacuum of some other peoples lives.

Ok. Say I go postal on him..... well I did! When I was there to pick up the car and it was not ready. Not only had I driven 9 hours to get there, he was not there and he had not even started completing the car!!! I was like, "what the f**k!!! I drove 9 hours we agreed 2 months ago and you are not even close!!!!"
He had a list of excuses and the day drew on. As I realised he was not going to have it done. I left with him and the shop manager in agreement that they would drop it off the following week!!!!
This did not happen as I mentioned earlier.
We have had subsequent discussions and he now says he wont deliver it because of a rattle in the front suspention from a loose thrust arm. "Its to dangerous" he said. I made it clear I wanted no other work done. "Dont fix it dont do anymore to the car, im coming down to get it".
I also have another car there that I said I wanted to retrieve aswell. We agreed on the weekend of the 25th to do this and to end the drama!!!!
Now he's not in the state dealing with personal stuff apparently.
I asked yesterday to firm up the 25th and he was like "I dont give a f**k about your car, I thought you understood the situation im in!!!, I cant come back yet!!!!!
So how do I compel him to?
From what I've read, legally this is a civil matter. Money has changed hands and for all intents and purposes the work is done. I just cant get him to release the cars. Now I cant consider a situation with him not there while im collecting the cars because of the parts I need to collect that I need to ensure he removes...a complete m30 race head, a t4 ball bearing turbo, complete forged internals, a euro body kit all for my 635 which is there also behind a number of other cars. The 740iL for all I know has been used as a shop car (now that its running........) I mean its a fricken mess!
I would love to get a crew together and just pull it all! But he is not there and may very well not be for some time.
Ok so there's the balls out situation. Really what can I do?. ....oh and I have his loaner car in my garage with a buggered trans. It was a placatory measure of his to keep me rolling while he was "finishing" the car last year!!!

Don't walk onto someone else's property and take things, even if it's yours.
Two things you can do, but neither will be quick.
1. Call the local police and explain the situation. If you have exchange money and you cannot get your car back and the other side is not responding you may be able to claim theft. If the police don't want to do this...
2. Most states have a small claims court for matters less than about $5000. Find out what it is in his state, give him one last warning that you are about to sue, and if nothing file a small claims complaint.
Do everything in writing.

Good stuff this.... I had visions of turning up with 20 or so guys from the forum in their 740's and storming the place to retrieve their captive brother.
Will check with local statutes and the chamber of commerce as well.
Hoping to stay on talking terms just to get a date to extricate the cars.
Whatever you do, don't give up. Its been too long of a journey, with too many shops taking advantage of your patience and good nature.
Just don't want to see you getting screwed, again.
If I were a bit closer, I'd offer to stand by you and help retrieve what is yours.
Thanks Haadkoe, glad you see my plight. Thing that bugs me the most is missing two consecutive Bimmerfest's weekend meets and tinkering I could've been doing.
I have a nice warm garage for the e24 to work on this winter and a covered spot for the 740 once I eventually get them.
Willc has offered his valuable time to do the Carolina run so I am excited to be getting closer to end this freaking drama.

Good luck, and try to stay on top of those clowns until you get an acceptable resolution. I'd be calling at least once a day asking for a progress report and pushing for the vehicle and parts release. Even if the man himself is truly out of town, chances are someone has access to the shop who can release your items if it's in their best interest to do so. Whether it's because you became a pain in the rear and they just want to get rid of you, or because they are fearful of legal recourse, etc, I'd be pushing until I got what was mine. All things considered, paying an attorney a bit of money to send him some threatening sounding legal documents might be of assistance if your attempts at recovery fall on deaf ears.
Still nothing from the shop owner. Will try the office again today. Really need to get my cars out of that place. So peeeeeved!!!!!!!!!!!!
Just off the phone with a lawyer. Says the shop behaviour amounts to breach of contract at best though could pursue with conversion charges. If I could find someone local to the shop or a group of people with a signed authorization from me to remove my cars would be best.
Repo companies want $300-$500 per car! and then there's all the parts that have to come with the 635 turbo ....... what a nightmare.
Wish he'd just call back so I can make a weekend to get down there.

$300 per car might be worth it in the end. When was the last time you saw the cars in person?

Last seen in August. Drove there (about the distance from Adelaide to Perth!) and the 7 wasn't ready! So unbelievably peeved. Then he didn't bring it back the following week as agreed...... so many layers of pissed off.
I did see it running though after he aligned the keys/cluster/computer. Hope to drive the 7 back and trailer the 6 with all its parts I hope to find.
