Annoying hesitation when moderately accelerating at highway speeds

when cruising at 40+ mph and you try to accelerate moderately (as opposed to gunning it in passing gear), the engine hesitates. the hesitation is consistent no matter what speed. it feels like a vacuum leak but the bmw dealership says that although they acknowledge the hesitation, they can't fix it.

sounds too ridiculous to be true.

anyone experienced this?

I have the same problem feels like a skip in the engine only at very specific speeds and specific RPMs
