Long story short i was waiting to trun left and i got rear ended. 100% his fault and he had no license or insurance, but mine will cover it.
I was just wondering how they determine how much the car is worth. I know they total it out if repair cost is like 70% of the value, do they use blue book numbers? I have a 1996 328i fully loaded. It was in mint condition with 167k 5 speed.

Sorry about the huge pictures, that's how they came off of the camera phone. There might be a part out coming up for this car... Hopefully i could just sell the whole thing at once since i don't have the time to part out a bunch of stuff. It still drives straight but the frame or something inside of the trunk was crinkled and obviously the rear quarter is crinkled and would need cutting and welding, possibly frame straightening too. The insurance guy looks at it on wednesday so i will keep anyone intersted informed, just trying to figure out what to expect.

That blows-- the crincle in the rear quater is the bad one.

They have their own numbers to use -- not bluebook. It comes out pretty close though. You have to watch them because they'll try to weight it in their favor so the payout isn't as much.

Buy it back, trust me. You'll turn profit parting it out. Hell, nearly every body panel, and interior is in good shape.
OR keep it, buy another E36, maybe one for a good price in less condition. THEN SWAP parts out, then sell whatever parts left or from the new e36 in your hands on here. DOn't let the insurance guys take it away.

Yea, i'm going to be buying it back because it is, or was, in way too nice of condition. I already found tail lights, bumper, trunk... and all the stuff that was wrecked. Found a car that had a fire in the engine bay so i have the whole rear end... too bad i can't unbolt the frame and replace it haha. But i looked up retail on the car and it said 7500, i doubt i'll get that much from insurance though... It's totally the other kid's fault and he had no license so my insurance is going to cover me and then sue him basically is what they said so the money won't be coming out of their pocket for the car, just their time but time is money so who knows...

Do not let thme use blue book or their own numbers. WHat you need to do is start putting together your own series of numbers, from newspaper, Craiglist and Ebay on the real price it would be to replace your car. Make sure you have any reciepts for parts you bought that are still under warranty, and make sure as hell you do not accept any check as a "partial payment".

There are a few options, the first I doubt would go in your situation which is reimburse you for the damages only, they mind as well buy the car from you for the damages; which is another option.
Another is to get it repaired; if they even will be willing to repair it for you. You can also buy the car back for the salvaged value of the car which is a few hundred dollars which in turn would slap a Salvage title on the car.
If you really want to negotiate with them, Ive done it before, do a buyback on the car which the damage payout is a bit less than a salvage payout but you will retain a clear title.

If they try givin me the shaft and lowballing, i will have to argue. I want to get to an autobody shop before i go see him so i have some numbers to back it up and not just thoughts.
My friend did that once with his truck, they wanted to total it out but he still wanted to keep it, he got the most of the money for the truck but got to keep it and it didn't have a salvage title. I;m thinkin with a couple hundred bucks and some muscle it could be in decent condition and then i would just sell it and tell the buyer what had happened but that they're still gettin a hell of a car for what they're paying

the insurance company WILL lowball you. when i wrecked my last car they came up with some of the dumbest deductions i have ever seen.
first thing, they told me that the engine and trans were in "poor" condition because they were leaking fluid... i told the guy straight to his face that he was a dumbass because the block was broken into 3 pieces by the wreck and the trans also had a huge crack in it. he tried to tell me that the car was still in "drivable condition" with the motor like that and i had to get the yard manager to come out and help me convince him that a block that is in 3 pieces WILL NOT RUN. lol. he also tried to deduct bcause there was no oil or coolant in it. i had to show him the pic of the street where the wreck was to show him that it did in fact have coolant and oil in it at the time.
#2. he told me that the headliner had footprints on it and was, as such, in poor shape..... yeah it had footprints on it because when the car was on its roof i HAD to walk on it to get out...
#3. then he tried to tell me that all my lights were burned out........ that one really pissed me off because the battery was in the backs seat..
then it was just alot of stupid stuff and i ended up walking away from him before i knocked him out and went to jail over it.
whe i got one of my friends who is a lwayer to call them up they paid me real fast and i ended up keeping the car and getting more out of it then i payed for it and i also got to sell it for scrap and got an extra 500$.
so yeah, long story short watch out for em.

If they try any b.s., just get a lawyer. You can't play with these assholes, give them anything and they will fuck you royally. This is why insurance companies make such a large profit, because they never play fair if you don't have some muscle behind you to back your losses.
Sorry about your car. I hate people who can ruin a beautiful vehicle like that.

Sad; they will never voluntarily give you what it probably would have brought. Have some ammunition when it comes time to start talking appraisal, and if you plan on keeping it, what the junk value is.

I just went to an auto body place and they estimated 6,604.94 to fix everything so it's going to get totaled. He said that was 100% of the value, so we'll see what the insurance company says that it's worth. My friend is already anxious to buy my engine and trans... we'll see what happens. I don't want to turn this into a for sale thread so if anybody is interested in anything send me a message.
