View Full Version : has anyone here appealed a surcharge before the Mass. Div of Insurance?...

I unfortunately spun and hit a guardrail. I recieved notice from my insurance that I am at more than 50% fault for the accident so I will be charged a surcharge on my insurance, unless I appeal. Based on what happened (9PM, raining, had to avoid an obstacle on the road, swerved... hit guardrail) I think I could make a case). Just trying to get a feel for the whole process.

... i got a form mailed to me for when i went off a road in a snow storm... i just outlined exactly what happened & drew pretty pictures on the generic diagrams they sent me & got it pulled... dunno about your situation

thanks for the info. Did you have to attend a hearing? my form indicates that if I appeal, they will notify me of the time, date and location of the hearing.

hey, sorry about the long wait... usually i'm no here like once or twice a day, but i've been wicked busy this close to the end of college :clap:

um... nope... what happened was i slid off the road in a really bad snow storm a few years ago... i can't remember where i got the insurance form, but i'm sure if you just contact them they'll send it out to you...

basically it was just a questionair about the conditions etc and why it was the weather that caused the accident. i filled it all out, sent it in and i didn't have to pay the surcharge/deductable, or whatever it is

even if you have to go to a hearing i say do it... i'm sure it would be kinda like appealing a speeding ticket or somethin

again, sorry for the long wait... wish i could be more helpful for ya, bo

thanks for the info.. I'm definitely appealing, in fact I just finished filling out the form and I'm mailing it this afternoon. Hopefully there won't be any need for a hearing,

when you mailed in your appeal... how long did it take to hear back from MA Div of Ins? just curious, I mailed mine in almost 2 weeks ago.

eesh... i can't even remember... it was like 3 or 4 years ago & my parents handled most of it since i was using the same insurance carrier as they were

Appealed an accident years ago lost horribly. Lady was cited for speeding by the police (she admitted she was speeding around the corner). I was making a left turn, she hit me in the left corner panel spun me 360 degrees in the middle of downtown Andover.

Insurance said it was my fault becaause I was making a left turn. Guess under Mass law you can just hit anyone making a left turn at it is their fault.
