I'm trying to find out more about this car and its owner. He's trying to get out of an Ebay auction. Any help is appreciated!

Yeah, I won the auction through an Ebay Store ad. This guy now doesn't want to give the car up despite a legally binding contract, and a winning bid above reserve price. Can he even do this? The car's in Modesto, California.

Good luck trying to get Ebay to make him sell the car... sellers usually reserve the right to modify their listing or reserve the right to end the auction.. or anything..
you'll have to wind up taking it to court... all ebay can do is cancel his account... which he'll just make a new one later on....

Yep the car is yours. Now I guess it depends on how far you want to take it - legally.

Well, the thing here is... Not only does the guy have a contract with Ebay, but also with the Ebay store. To even make a bid is a legally binding contract in which the bidder can receive legal troubles after failure to follow through, so I am dumbfounded as to how or why he (the seller) could get away with this.

Im not following.. if he didnt want to sell it, he should've just closed his auction before end. Cant they do that? :confused
Anyway, if you haven't sent any money, I'd probably just forget it. If nobody has lost any money on the deal, it's probably not worth the headache of fighting it. :dunno

Your not getting the car, it would cost more to bring him to court with time and money than the car's worth. And by then there will have been 10 more cars that would have caught your eye.

I have a deposit in escrow with the Ebay store. This was a 3 way sales contract in which all 3, seller, Store, and buyer have to sign title in order for exchange. The guy even tried telling the store that the car was having mechanical problems and didn't want to sell it like that, then later came clean and said he doesn't want to sell it anymore. WTF?
