Mini just bent me over, and may or may not fuck me. I ordered my R56 on november 19th, with a 3.5-4 week delivery time. Here it is 2008 and not only do I not have my car, but I'm never going to get it! Apparently it needed more than 3% of the MSRP in repairs when arrived at port, so BMW will not deliver the car. They have offered me a 2008 for the same price, which I feel is the bare minimum they should do (as it is the same car), but I still won't have it for at least another month. The worst part is, it's already paid in full, and has been since a few days before the original due date, and I'm wasting tons money in lost interest and gas expenses (my eurovan gets half the MPG that the mini does). I guess this is all better than being stuck with a lemon mini for the next several years, but god damn does this suck!!! I've requested the sport suspension and xenon headlights as compensation, and am waiting for a reply... will post more news when I get it.. For now, the 325iX gets more attention!

accidents happen, at least they told you and are compensating you

I see your point, but I don't consider it compensation. I understand that accidents happen, and nothing can make things as if they didn't happen, but I don't think it should be my problem that they fumbled the whole thing. I feel I am entitled to an '08 car at the same price, seeing as how its the same exact car. Compensation to me would be having them throw something else in, or discounting the car. Also, they never told me, I/the dealer had to drag it out of BMW/Mini. First it was just going to be repaired, which they never reported to the dealer.. after 2 weeks of sitting on the dock and the salesman leaving voicemails with Mini they finally fessed up what the holdup was. Most recently, the salesman went to check the status of the car and it just wasn't on the inventory list- he had to call and find out why.

Sorry to here of your woes. The port centers always report damaged vehicles to the dealer, sometimes in not so timely a manner.
They will not sell a car as new if the damage is over 3% of MSRP, so you should probably just forget that car. It might get repaired, and wholesaled with a big disclaimed, or crushed. But, as you say, it won't get sold as new.
You can always order an 08, or have them locate a similar one through the dealer network. Maybe even one that has some options you didn't order. There are a lot of 07s out there on dealer lots.
How can the car be fully paid for if you don't have possession yet? I don't understand that part. You could always request most of your money back, and interest and gas mileage compensation.
So, this is Jan. What's happening now?

pbraun- the car is paid for because I happened to be down by the dealer a few days before it was due in and i gave them the check, so they could get everything ready (paperwork, etcc) so that when it came in so i could just swing down and grab (my schedule was incredibly hectic at the time, and the dealer is about 45min-1hr away).
UPDATE- I heard back from the dealer yesterday, and mini has agreed to eat $1000 on a 2008, and the dealer agreed to eat $500. So I'm getting the xenons and the thicker sways for $150 more than I would have paid for the 2007. I AM EXTREMELY PLEASED with what Mini and the dealer has done to compensate for Mini's major fumble. I'll post pics when I get it next month!

I have not yet and I even let my BMWCCA membership lapse when I lived out in Seattle (BMW was in NY). I'm going to join again soon. I'm about 45min north of albany right off of I87.
