View Full Version : RSM Failure. Hoodwinked? (Cont'd)

So, I just picked up this M3 less than a month ago. Come to realize today after I was going to replace the shocks/springs, rsm's and rtab's, is that the car didn't even come with a rear driver's side strut. It looks like the previous owner has an RSM failure. Its been ripped out and there's a gaping hole now.

So, am I correct to assume after buying the replacement perches from that this fix will be around $500? Also, anyone know of a good place to get this part welded in, in the PDX Metro area?

Also, should the place where I bought the car, disclosed this or...? I feel like its kinda unsafe and they should've done the once over before allowing the car to be sold.

/\...that really sucks, did u do a test drive before you purchased the car? you should have heard it while you were driving the car...


but this is also why people on the forum suggest a pre-purchase inspection....


anyway......yeah you can buy the sheetmetal piece from the dealership, and any shop can cut it out and weld it back in place.....shouldnt be more than $500 total.

as far as taking this into a legal matter, you would have to talk to a laywer...though i dont think this is gonna be worth fighting over $500.

I heard about the RSM failure and thought it was that. I didn't know the whole tower and shock/strut wasn't even there. $500 is some money.... I don't want to make it a legal matter, but they should pay that shouldn't they? Without the strut/shock the car would be unsafe and they can't legally sell an unsafe car right? :)

TALK TO A LAWYER. Do you mean that there was no rear shock on that side? Or that it was there, but had ripped the sheetmetal tower? (not unheard of...)

I mean, there was no shock. NADA. Its not like it ripped and fell out because it'd still be there dangling and attached to the rear sway right?

I'm trying not to come off like a prick here, but how did you not notice the strut missing from the car prior to buying it?:(
It's not like it's a hidden thing, you can see it if you just look and this is another reason why PPI's are so important, although I wouldn't even have gone that far with it in this case.

And I seriously do wish you the best of luck in getting this situation resolved, but considering the seller was willing to sell you a car in that condition they're probably not the most upstanding of folk.

Has the shock tower been torn, or is it just a matter of the missing shock?

The shock tower is torn and its missing the shock. I didn't notice because the rim/tire is big and of course, the car sat lower in the back. I didn't do a PPI which was my fault.

if you got it from a dealer isn't it their responsibility to check over all cars when they buy them, or atleast sell a car that has everything in it?

For some reason I feel like you could sue the crap out of them haha, just because I'm taking a business law class this semester and all we talk about are these rediculous cases where people win big $$$

I'd call and ask, did it come with any kinda of warranty like a 30-day?

How are you going to prove your claim?
All the seller will say is the shock was there when sold.

Yes, it's illegal to sell a car that isn't roadworthy, if it is to be driven off the premises.

nope.. no warranty but they put in writing that everything was checked on the sale reciept.
