okay, speeding ticket 2... I have come to the conclusion that my speedo is busted... I KNOW that I wasn't going 59, I know I was speeding, I saw 55 and started to cut back before the cop was even in sight, I was doing 45 and he got me at 59... is this even possible on the speedometer?

Try borrowing a gps from someone and check your speedo. In my Z3 it is off about 5-7mph faster than I am actually doing. My truck is right on.
Do you have stock size wheels? That could also be an issue.
My 318is always reads 5mph faster then I'm actually going.

Might it be that the car was clocked by radar before you started slowing down?

I think I have it... I found a problem in the connector to the speedo... it was loose. It was going in and out of place, so I'd speed up to a normal speed, it would come out, then the needle would drop as a result, so I'd speed up and then eventually, the connector would move back in place and it'd show my new speed since I sped up and I'd end up at a higher speed... if anyone understands my complicated and stupid explanation of this problem... please let me know if it is a legitimate argument in court.
EDIT: I forgot to mention that I removed my cluster to find this out... I didn't just guess lol

I doubt that an equipment fault in the car is going to be a useful argument in court. The presumption would be that if you properly maintained the car the speedometer would be optimistic at worst.

negative ghostrider. Faulty equipment due to poor maintenance is not an excuse in court. About the only time you can try to use faulty equipment as an excuse is when you are pulled over and you tell the cop you are aware of the problem and the required part to fix it is in the mail, but since this is your only means of transportation, you are trying to be as careful as humanly possible until the part comes.

Looks like it's time for you to just pay the ticket. I don't know about NY but in MN, if you use the bad speedo excuse, they will give you a ticket for that and the speeding ticket.

I guess NC has a different set of laws. Especially if you provide a letter from a mechanic, you can often have your speeding ticket reduced to "Improper Equipment", which adds points to your license but doesn't impact your insurance itself (you can hit a points threshold where your rates go up). Here, they have a cattle call to talk to the DA if you want to ask for a reduction, etc. so you have minimal time in front of a judge.
If you aren't familiar with how the system works where you live, get a lawyer. In the long run you'll save money.

my mom talked to a cop she knows, he said as far as nys goes, we just need a signed thing from a mechanic saying that we did had a real problem. Then the tickets are dismissed

Where did this happen (ie: Endicott, Bingo??) A letter from a legit mechanic (not Joe the mechanically gifted friend) MIGHT help you out, but not always. Take it to the DA and see what he can do BEFORE it goes to court. A lot of times, working with the DA, If you give him a good impression, will work to your benefit. He might dismiss it or at least tone it down to something like an equipment violation. It doesn't hurt to try.
I got a ticket in Conklin years ago. I was doing 55 in a 40. I plead guilty and paid the fine. It was afterwards I found out that I could have taken it to the town clerk and might have been shown some mercy.
I would also keep that car out of his sight. He might throw the book at you if he sees it...........

This might be of some help.
Perhaps you could schedule this before you go to court.
It would show good faith on your part.
Tickets & Driving Schools
http://www.dmv.org/templates/html/db4/img/icons/tickets-&-driving-schools-big.gifOnce you've invested all the time getting a New York driver's license, you'll want to do your very best to retain it. During your tenure as a New York driver, you may make a mistake and be cited for a traffic violation.
While one or two citations over a driving career will not cause not much trouble (depending on what type of infraction they are), it is always best to keep your driving record as clean as possible. One major reason for that is that your insurance rates are determined, in least in part, by what kind of a driver you are shown to be by the number of tickets you have received. Another reason is that the State of New York can suspend or revoke your driver's license if you rack up too many tickets.
If you do get a ticket, you'll want to clear it up as soon as possible. Many states allow drivers to sign up for traffic school to reduce points against their driver's license. See our section on New York to see if you are eligible.
You don't usually pay your ticket in New York at the Department of Motor Vehicles ; usually those fines are the jurisdiction of the county courts, although the Department of Motor Vehicles does track the number of tickets you get.
New York Traffic Schools (http://www.dmv.org/ny-new-york/traffic-schools.php)You may be able to complete a traffic school course in order to lower fines, reduce points, and keep your insurance rates from going sky-high. See traffic schools approved by the Department of Motor Vehicles here
