I purshased a 2004 530i with 5200 miles on it from my local BMW dealer. The tires are Goodyear Eagle 245/40ZR18 93y run flats. As I drove the car more, I noticed a whining noise coming from the tires. The dealer said the tires were cupped causing the noise. BMW said they could do nothing about the tire wear! As I investigated further, I found that this condition of noise and tire wear is described as normal vehicle function and normal tire wear for an E39 5 series with sport suspension. Unfortunately I had to replace the tires at 8200 miles with the same brand. This seems to be OK for the Germans but I am not accustomed to replacing tires with this low mileage. Apparently BMW North America hasn't told their customers of the potential excessive tire wear. Has anyone experienced a similar situation?

You should have simply bought a "touring" tire instead of the same one you were dissatisfied with. You can find almost any tire in a low profile 17" tire. Not sure why you felt you "had" to by the same one. Sport tires get loud as they wear although most have much more mileage than 8k. I can get 20k out of S03's on my M5.

You should have gone with a different brand tire...

I have this issue with a 325. Pirelli tires that are cupping and the Factory won't help.

Any advise?

#1 - ensure shocks and suspension bushings are in good condition
#2 - ensure wheels and tires are properly balanced
#3 - ensure the car is properly aligned, paying particular attention to the toe settings
#4 - maintain correct tire pressure

Most overlooked cause for cupped tires, if you have much more than 60-80k miles, new shocks would do your tires good. :)
