my friend was driving in his brand new 05 MDX, goin home, hes in the middle lane and an M3 is behind him. the M3 tries to pass him on the left lane, but the left lane is a solid line. M3 cuts him off and hits the MDXs front fender with his passengerside rear quarter panel and door. M3 guy lies to police... and says he was in the middle lane and my friend tried to cut him off from teh right lane. i wasnt there, so i believe my friend's story. the cops made the M3 driver take 2 breathilizer tests. the cops didnt do anything to my friend tho.

Even if your friend tried to cut him off from the right lane, the damage would be completly different, it would be your friend's rear quater that was messed up and not his front fender. If the police wrote your friend a ticket, they are gay :shifty

no, no tickets were issued. the cops will file a accident report. the drivers went on their way...

Thats what i was thinking. Why the hell is the BMW guy on his cell phone when the cops are giving him the test? :confused

I take offense to this statement. How well do you think YOU would do trying to figure this situation out when everyone always lies their @$$es off. Besides, you were completely wrong, as no one was issued a ticket. Score one for the "stupid" cops.
The damage makes your friend look guilty. He could see the BMW changing lanes and should have backed off (this is a generalization, but it does match the pictures). The van was in the BMW blind spot. Is it possible your friend pulled a 'oh no he isn't' and sped up to prevent the BMW from changing lanes? Just playing devil's :devillook advocate.

From the damage it would appear that the M3 would have had the right of way. However, The damage does not corroborate his story of the MDX cutting him off.

Get off the phone!
You are being interviewed by the NYC Police and being given a very serious test: one that could be used to charge you with a felony.

That sucks man. Look at it this way, the cops could have given you both tickets.
BTW- That BMW (is an ugly color combo) has about 4k in damage to it....

If it was any of my friends then no cops would be needed, that guy would need a paramedic on the scene. People are just dumb. I hope everything works out with the insurance.

From the damage it would appear that the M3 would have had the right of way.
What the heck are you talking about? How does he have the right-of-way? So, once you are a half car length ahead of another car, you have the right to move over into their lane and expect them to slow down to let you in?

I meant that since the M3 damage is closer to the rear & the MDX damage wa on the fender one would say that the driver in the rear should have braked for the drive ahead of him. Otherwise, why would the MDX drive try to switch lanes without proper clearance?

According to the report, the BMW tried to switch lanes without proper clearance. When someone to me left tries to force their way into my lane, they don't have the right-of-way.

Yeah it looks like the BMW sped up in a last ditch effort to cut off the MDX, and the MDX was like "Oh no you aren't!". And the idiot BMW guy committed to it.
I've always worried about arrogant drivers doing this to me.... man that sucks.

So according to you, any car can cut in front of you whether or not they cleared your car, and YOU would have to stop? How about the driver who wants to changes lanes either: 1) changes lanes without hitting the other car, or 2) back off and not assume s/he has the right of way when it is clear there is another car occupying the spot.
Something similar happened to me a while ago. I'm driving along in the #1 lane on the freeway. My front wheel was lined up with the the rear wheel of the car in the #2 lane. The driver signaled and started to move over in the same motion. I got on the horn, and the driver moved back to her lane. She then flipped me off! I know it's my fault that physics won't allow her car to pass through mine. And, it's also my fault that I didn't slam on my brakes to allow this driver to cut me off, because after all, if you signal, it automatically gives you the right of way, and everyone has to stop traffic to let you by.

Go back & read.
I simply meant that just looking at the cars, a car with rear end (from the driver's door back) & a car with front end (fender) damage, usually the car with the front end damage is looked at as liable when there is a discrepancy.

If you tell that to someone, you better at least spell "phonics" correctly.
Anyway, from your initial posts, it is very easy to interpret what you were saying is that in an event like this, the car getting passed is at fault. Maybe it sounded different in your head, but when I read it, that's what I thought you were saying as well. I consider myself fairly educated.
Also, can you explain why "cops suck"? I wouldn't like to live in a place without law enforcement officials.

i dunno if this is clear but the M3 crossed over a solid line to the left lane and then he cut the solid line again to cut in front of my friend. i think that is y the BMW driver lied, otherwise he would be fcuked... my friend is one of those ppl that might speed up to not let the guy in but i kno hes not stupid enough to clip someone in the rear, the M3 would be in front of him in plain sight, and hes in a SUV, which makes it easier to see... he still has the right of way because its a solid line... the person on the left lane should not be changing lanes at all...
to me the damage looks like the M3 tried to squeeze in but didnt have enough room...
my friend shows care for the MDX, he was about to get a small ding pulled this weekend too so the MDX would look flawless.

Kind of off topic, but in the 3rd pic the M3 driver looks like hes leaning up against the paint in jeans... dont those things have little metal things on the ass that shouldnt touch paint cuase it will scratch it? Guess its just one more thing proving he doesnt care about his car...

The fact that the M3 was passing on a solid line should put him at fault. The cell phone Žitch shouldn't be passing a solid line anyways.

The BMW tried to pull a stupid stunt, and the MDX driver decided to be just as stupid and speed up, or not back off to let him in; how easy that would have been.
Two stupid bull-headed drivers in the same place at the same time = wreck. Notice I didn't say accident. They both made a conscious effort to do what they did.
Cops are people too. They aren't perfect, but heaven forbid any of you cop haters has an emergency that requires a police officer; you'll be praying they get to you.
"Officer Jones here, what's that, you say somebody is outside vandalizing your car? Oh, wait, aren't you the guy who said cops suck? Well you need to talk to Mr. Click....CLICK......dial tone.
Turn about fair play? Of course not, but you would deserve it - some of you need to wipe your noses and grow up.

How do you know? Maybe the Acura driver never had time to react if the BMW swerved into the lane because he realized traffic was stacking up in the lane ahead of him. Regardless of what the Acura driver did, he wasn't at fault here.

I dunno. Was the guy being given a test on the cell phone, or were the police allowing him to call home/the insurance company. Also, not all jeans have pointless metal buttons on them. The ones I wear don't, so I don't think he'd scratch that beautiful blue paint.
I was on Rt 11 going to Bloomsburg a year ago just going 55 (the speedlimit) when the conversion van that had been tailgaiting me for the past mile just finally gave up. He passed me on the right, kinda half on the shoulder, half in the mud and grass at about 65 mph. He could have easily caused an accident and gotten us both very badly hurt. Haha. It was an old dude to with his wife. Very old couple. I didn't do anything about it, I just looked at him in disbeliefe and he looked at me like he was doing nothing out of the ordinary. No horn honking, no mashing the loud pedal in third to keep him at bay, just the most awkward eye contact ever. If you've never traveled on Rt 11, there are two things that are very common there. Passing zones and cops. I just really wish that a cop had been there to see the whole thing. :)
