335i wastegate rattle and warranty questions

Alright I have an 08 335i, and it seems as though I have the renowned WG rattle. I called BMW Seattle with my VIN and they said I am still in warranty. Only problem is that I have an AFE Cold air/Ram air intake. I called another dealer and asked them if that would be a problem and they proceeded to tell me yes that it would void my warranty (complete rubbish). Anyhoo I just bought the car and I only have 4000 miles left on the turbo warranty. I also do not have a stock intake to return the car to stock. Anyone in the Seattle area willing to sell me a cheap ass stock intake? Or does anyone have experience with this kind of situation?

Your turbo including waste gates are covered to 82K miles and 8 years. Are you saying you have that mileage?

Thus you have plenty of time to get a stock air filter housing.
