No seat belt, did the bag deploy? You're fortunate to be able to start a thread and should be thankful that you around to sell the 540.

It's good that you're un-hurt, but no seatbelt going 80mph? (before you slowed down to 60mph just before the collision)
I made my daughter learn the habit of buckle her seatbelt before starting the car.

+1 I'm confused as to what your repaying aswell. You say its brand new, so I'm taking she has a loan on it. Therefore the bank would make her have full coverage insurance. That should pay for everything minus a ded. So I hope your not selling it so you can pay the deductible. If she can afford a brand new infinity, she shouldnt make you sell your car.

The difference on the lease of the car after it is totaled out will be less then she owes

Yes it was a lease so after it is totaled out the heck for the car will be less then the debt owed on the car and believe me she can afford it but I need to own up to my mistakes and pay the difference if the difference is a lot

I don't get into any front seat without a seat belt period.

I hope all is well, you selling your car to pay her deductible? Her insurance rates are going to go through the roof.

EDIT : Damn I just saw it was a lease, what was the payoff at the end of the lease?

I'm not positive that's why I don't know if I will have to sell the 540 yet because it was a really expensive new car so I'm not sure what the difference is going to be

If you gap insurance, it should cover the difference... thats like the first thing the finance guy tries to cram down customers throats

At the end of the day, it could just be his Mum giving him a hard life lesson. You totaled a car, you loose car privileges... :dunno

With a lease car, you are required to have enough insurance to cover the Total Loss of the car - and Lease Insurance Rates are higher because of this. The whole idea is that the Finance Company can recoup the total cost of the car - including the car's calculated residual value. With lease cars, the idea is you return a car in a certain "Good" condition for resale.

OP is not sure yet if he will have to sell his car, but I can see a parent requiring that as a lesson or losing driving privileges for a while as I said above.

You are 18, you will learn along the way. Hopefully, this was a lesson you won't dismiss nonchalantly. I am sure a bunch of us have made mistakes along the way. Take your knocks, learn and move forward.

Im surprised it was allowed to happen... I assumed most dealers required gap insurance...especially on something this expensive.

good luck, Im thinking the difference is gonna be several thousands...maybe even more than your e39

aquila explain this nicely, in a nicer way.

'cus my brain is about to explode reading all the shenanigans.
and apparently you haven't learn your lesson, and you prove that to us by talking about the insurance company, or your mom's decision.

I don't get why other members are being extremely nice to you just because you barely escape death.

That's what I'm starting to think , and I'm not sure either it was a car she got after trading in a lease on another Infiniti

In Florida gap insurance is only availalbe when financing a vehicle. If the vehicle is leased it will automatically have gap insurance (as well as some other things like 100/300 coverage). This is why insurance on a leased vehicle is generally more expensive than what one can get on a financed one.

I don't understand what you are talking about I made a childish decision drove recklessly and it resulted in my moms 50,000 $ Infiniti to be totaled which happen to be a lease with no gap insurance and now there is a possibility that I will have to sell my E39 540i to cover all the financial costs such as the 2 tickets I was sighted one for reckless driving and the deductible and also the cost difference in the lease and the check for the totaled vehicle
