Hey guys. I got towed a while back and the towing company said that they are not responsible because I cannot prove that the damage was not there before. The only proof I have is my word against theirs. AFAIK there was only one driver. As you are all beemer drivers, you know each and every ding on your car, if any. Should I persue this? Any help/comments?

Why was it towed? If it was towed because you parked illegally and the police had it towed there should be a form that has all pre-existing damage marked on it. Find out if the tow company uses any forms like that for other tow jobs. If there is no form that showed pre-existing damage or lack thereof you're probably screwed. All they have to say is what they already are: "we didn't do it". Maybe if you could somehow show that the damage you have could only possibly have come from their equipment you could get something out of them, but don't count on it.

It would be hard for you to prove that they did the damage to your car. I'm assuming that you mean that there is panel damage on the passanger side door.
Unless there is actual damage caused by towing such as if they used suspension parts to tow the vehicle and it damaged those parts.
Sorry to say though but unless it's worth the cost of repair I wouldn't bother chasing it. :bawl

My steering slipped a notch once from a tow.. probably as they dragged it out of the ditch it was in... but it was being towed by a body shop and they fixed it up in about 15 minutes.
At least they used the rear tow hook and not the suspension to pull on it.
Luckily the car was driveable and they only had to drag it a few feet.
