My 325i auto has been acting funny lately. When i go to put my car into reverse or drive, it takes a second or two to engage. then on the highway, depending on my rpm level, it will shift back and fourth between third and fourth. Do i have a torque converter problem? or could it be something else??
Really if its either the tranny or the torque converter thats the issue i'll proabably go do the manual swap. But if it just needs a flush then I won't

My fluids are all full. Tranny fluid is a little dirty but not too bad.

Tell me what you think.

I would stop driving it and do an immediate tranny oil/filter replacement.

When was the tranny fluid and filter changed last?

The delay going into gear could be numerous things. Often refered to as a "sleepy transmission", I would start with the fluid and filter change. As for the up-shift down-shift problem do you have a MIL? That could be the pressure control solenoid, to test the pressure control solenoid using a DVOM set it to ohms, check the pressure control solenoid circuit between terminals 40 and 41 at the TCM. Solenoid resistance should be 2 to 6 ohms. If you are not experienced performing this type of testing have someone do it who is. You do not want to create new problems.
