hey guys I'm quickly running out of options thought someone on here would hlep basically I was driving and this lady stopped juat a tad short and we both pulled over and she was like "dont call the cops!!!" then drover me to staples to make a copy of of our insureance(i didn't have conislion) and the copied it and game me a copy then left I look at the paper the next day and it's just a copy of my registration and insurance and the right half of her card with her cin and last name the front end was quoted for 5800 so the company would total it I HAVE to have a xae to drice my mom says I should sue for pain and sufferin I could sell as is or part out either way I'm screwed any ideas? Is a 99 m3 is titan silber

You should have called the cops, seems like she is hiding something, even if it's your fault, always call the cops. I got ripped off for 1400 like that once, because i was being nice to the lady, never heard from her again.
2. Post pictures of the damage, we can probably tell you if it's worth fixing or not.
3. You can sue her for pain and suffering, but it probably won't work, and if you don't have her contact info, how do you plan to sue?

Okay here is exactly what happened, the light turned red and she stopped a little short. My breaks where just bled recently and, where working fine untill then they had to drop dropped about 2". So i pressed the break harder as fast as i could, but by then it was to late. She was in of those random soccer moms SUV or whatever with a huge chrome bumper on the back. So we pull into the next parking lot. I went to go look and there is a scuff mark on her shiny metal after market bumper. The front of my car looked like this

So after this she was like "DON'T CALL THE COPS" and was like okay... then she said "lets go to staples and exchange insurance" she drove me to staples after i locked up my car. There we made copy's of our insurance (or so I thought....) here is what i ended up with.

i think she is hiding something and i don't know where to go from here cause i don't have to collision insurance, and just got fired. should i sue for pain and suffering cause i was crying for 5 hours strait (it was my first car and an M3) i know I'm a guy but i was traumatized. Am i going to get sued? Should i look her up online and call her see what we should do i have not idea please help.

She stopped at a red light and you rear-ended her. You were driving a car with brakes that were not functioning correctly. The accident is 100% your fault. You have no grounds to sue for anything. Maybe she is on a suspended license or didn't pay her insurance but that doesn't change the fact that you are at fault. Your best bet is to hope you two f'd up all the copies so she doesn't have good information on you. As for the pain and suffering, give me a break. I have been crunched much harder than that at least four times I have yet to have an emotional breakdown over it.

So cliff notes - You rear ended an SUV with an aftermarket chrome bumper on it. Your car is extensively damaged and the SUV got a scratch on the bumper.
Your lame excuse is your brakes weren't working properly.
Bottom line - it's your fault all the way - you couldn't control your car for whatever reason and you rear ended her - you're at fault here.
Here's the good news - if she had called the cops you'd have a ticket on top of the damage. It sounds like she has some issue with the cops, maybe she's wanted for something. You'll probably never hear from her.
Now you need to figure out how to fix your car. You have no grounds to sue her for anything - she has grounds to sue you - it was your fault. Look at this as a life lesson, I'd have probably brake checked your dumb a$$ if you were following me that close - then you'd know what real problems are...

Well, it looks to me like you got the name of the other person and a VIN so I'd assume you could track them down through Progressive. Why didn't you catch this at Staples when the copy was made?
Anyway, Jhunter summed it up well. You don't really have grounds for anything here. If you didn't have full coverage, your car is just done. Doesn't look horrible though, hood/front bits from a JY may fix you up.

I am going to go ahead and sum up what people have already said, only simpler.
A. It is your fault.
B. Suing would be stupid, you are lucky you won't be paying her anything.
C. The damage can easily be fixed with junkyard parts for pennies on the dollar.
D. Get a job.
E. Invest in your education.

Total = $860
All said and done, with you installing the parts on the car and buying parts from the for sale section of bimmerforums. I would know, I JUST rebuilt the front of my e36 after an accident.
Granted, you could do this for a LOT cheaper if you find another silver e36 in the junk yard. I just live in the middle of no-where without a decent junk yard, so I had no other option but to use BF.C

Usually when people who's fault it was not in an accident don't want to call the cops, they just tell you "don't worry about it" and drive off. Obviously this wasn't the case as she wanted your information ... you should have told her to stay put and called the cops. I'm afraid this way, you're going to get screwed: who knows what she might claim now and you have no way to prove otherwise. And just a FYI: insurance information is exchanged by writing down the name, driver's license number and insurance policy number, not driving to Staples to make a copy.
That said, there isn't a chance in hell that's more than a 1000 worth of damage ... that is all easily fixable in less than a day.

Just to state the obvious.... That was hard as hell to read. If you are still learning english then it is forgivable. But if you've been here for several years I suggest going to an actual school to learn proper grammar... In the accident, You are 100% at fault. It doesn't matter if she stopped short, It is your responsibility to control your car at all times. Regardless what reason you have (brake fluid low). And 3rd... Simply put: Light turned red, she stopped. You were not paying attention to the lights and did not notice her stopping and/or you were following to close.
To sum it up, you are at fault and now you're fucked. Now take it as a life lesson and move on.

Do you have another way to get around? If so, keep the car, get another job, save up some money and fix the car. It's not totaled, so there's no reason to part it out.

You may never know what people will do with your address... The E36 doesn't look like a complete loss, Depending on how many miles actually. You can source all the parts cheaper then what the shop said on your own (ebay, aftermarket parts, craigslist etc...). That'll save you some money, But you'll never know the extent of the damage until you take everything off. But obviously you need a radiator support which is something a shop will have to do unless you're skilled with a welder. You can piece the car together on your own and save afew grand.
But if you are persistent on the E30 swap project, by all means go for it.

She didn't bail. You exchanged information (lack of copying skills not withstanding)! You are clearly at fault so consider yourself lucky she did not call the police. You would have been cited. You best hope is you never hear from her again.

How can you honestly think that you will be able to do an S52 swap on an e30 when you cant even tell if your car is totaled or not? I mean take things one step at a time. First figure out what you are going to do as far as insurance is concerned. Its obvious you cant really do much, you were at fault here. Second, get another job and reserach online DIYs on how to swap those parts that you need. Your life isnt overn and its just your first accident. Find a buddy that actually knows something about cars, and have him help you. Good luck.

My dad was in an accident about 12 years ago, rear ended someone but it was the lady's fault, I was in the car. The reason: everyone was stopped at a red light, the lady cut into my dad's lane without signalling then slammed on her brakes to not hit the person in front of her that was stopped. My dad had two witnesses saying that she cut in front of him with an unsafe maneuver which caused him to rear-end her.

I know that in Colorado you do. It might not be the same in all states though. I can't say for sure.
If you hit someone else you should be calling. If you back into a pole in a parking lot...well who really cares. Thats a self correcting problem.

Under Ohio law (assume most other states too) you are not required to call the police unless there is an injury. Even if the police are called, they are not required to "investigate" the accident unless there is an injury. The drivers are required to stop and provide certain information.

In Wake County, NC you have to call the cops if the accident involves 2 parties. You don't have to call the cops if it is a single car accident but I don't know of any insurance companies who will shell out any money without a police report on at fault and why the accident occurred.

Under NC law an accident must be reported if it results in injury, death or property damage over $1,000.

A friend of mine crashed my car about that bad, I brought it to a shitty body shop and the total was like $1,500.

This is one of those real-world experiences that home schooling won't provide.
When there's a rear-end collision, the cops will side with the party who was hit. The fact that your brakes weren't 100% will only work against you.
Fix the damage, and chalk it up to a learning experience.

One of two things I see here.
Either she doesn't have insurance, or she can't be found by the fuzz.
Track her down, now, tell her it's going to be $5800 in damage, you want cash yesterday, or the insurance will gladly take care of it.
She won't call your bluff and you'll get a free repair + some.

BTW, my car haz no brakes, I took them out for weight savingz. I currently use my feet to slow down, i.e. the "Fred Flinstone" mod. I waz just surprized by the audacity of someone stopping unexpectedly before me. Such thingz never happenz in teh real worldz.

BTW, my car haz no brakes, I took them out for weight savingz. I currently use my feet to slow down, i.e. the "Fred Flinstone" mod. I waz just surprized by the audacity of someone stopping unexpectedly before me. Such thingz never happenz in teh real worldz.
