Hi , I am looking at buying a 328i 2013 with sport package from carmax. It has 40k and a clean auto check and carfax. What would be the recommended extended warranty to purchase and what cost ? Would I be right in saying I am good for maintenance until 50,000 miles/4 years even though I am not purchasing from a BMW Dealer ?

The first thing you need to do is have the candidate car undergo a pre-purchase inspection (PPI). Find a reputable indie shop that specializes in BMWs. It'll cost you $150-$250, but it's money well spent. Use the issues found by the PPI to reduce the car's price.
As far as an aftermarket warranty, it depends on several things such as your ability to perform maintenance and repairs. Also, the size of your bank account matters, too. These cars have a lot of electronix and so electronic issues are not unexpected.
how much is the car listed for? Carmax is usually overpriced, sometimes I've found 1-2 year old cars are listed for same price as the new ones!
Also, I doubt he can take the car to PPI, especially from carmax.
That being said, if you like the car and the price, carmax usually offers a various warranty packages. Get a quote and read the fine print
